Mediation services benefit most in family cases

Mediation services will benefit the majority of people involved in divorce cases, but help needs to be available for those whom it is not appropriate.
This is the view of Resolution, which suggests that mediation is not the answer for as many as 40 per cent of family cases.
A survey from the group also shows the benefits family law, mediation and relationships operating together.
Nearly half (42 per cent) of its members believe that the right legal advice has meant that at least half their cases settled without going to court.
The government has recently been pushing mediation as a means of freeing up the court system, insisting that it is a "quicker, cheaper and more amicable alternative".
Resolution chair David Allison explained that the group is "committed to the constructive resolution of issues arising from separation, through options such as mediation", but expressed concern that the route is not suitable for everyone.
The government could end up punishing those for whom "it simply won't work through no fault of their own – for example, if they have an abusive or uncooperative partner", he added.
