Family Justice Review proposes end to court delays



A major review of family law, mediation and relationships has today (November 3rd) published its recommendations on how to tackle delays in the court system.

It calls for greater use of mediation services in order for parents to make their own arrangements for their children when they separate, and only use courts when necessary.

The report also proposes a six-month time limit in care cases to significantly reduce delays.

However, fathers who have gone through separation will not have a legal right to guarantee that their children have "a meaningful relationship with both parents".

This had been included in an interim report from the Family Justice Review, but is absent from the final list of recommendations.

David Norgrove, who led the review, said: "Our package of recommendations to the government and the judiciary will make the current family justice system more effective.

"We need to eliminate the shocking delays in the system."

The review also calls for Parenting Agreements and a new child arrangements order to bring together arrangements for children's care after separation, which will focus on the child rather than issues of contact and residence.
