Hotel porter wins share of ex-wife's lottery prize

The ex-husband of a woman who won £500,000 in the National Lottery is entitled to a share of the windfall, the High Court has said. In what Mr Justice Mostyn described as the first case of its kind relating to family law, mediation and relationships in England, the hotel porter was awarded £85,000. The judge explained that the wife was entitled to keep the majority of the money as it is classed as non-matrimonial assets. However, as she used some of the cash to purchase a family home, she had converted part of the windfall into matrimonial property. The couple, who were not identified, lived in the house bought with the lottery winnings for three years before they divorced. Therefore, the judge explained, the ex-husband was not entitled to a full share of the £500,000 property as he had lived there for a "relatively short period". While there have been five cases of this kind in Australia, Mr Mostyn noted that there have been no such rulings in English courts.
