Diplomat loses employment appeal tribunal over lip speaker



A deaf diplomat who took the Foreign and Commonwealth Office (FCO) to tribunal after seeking help from an employment discrimination claim solicitor has lost her appeal.

An employment appeal tribunal upheld a previous decision that Jane Cordell did not suffer discrimination after being forced from her job as deputy ambassador to Kazakhstan.

Ms Cordell, who is profoundly deaf, was told she could not take up her position because it would cost too much to pay for a lip speaker to support her in the role.

Supported by the Equality and Human Rights Commission (EHRC) throughout, she brought a discrimination claim based on disability against the FCO.

However, the original employment tribunal and the subsequent appeal ruling agreed with the FCO that paying for a lip speaker was not a reasonable adjustment.

EHRC commissioner and chair of its Disability Committee Mike Smith says it is vital that employers make reasonable adjustments for disabled employees.

"I am concerned that the outcome of this appeal sends the message that disabled people should not expect to get to the top of their profession, if they have significant support needs," he adds.
