Osborne promises employment tribunal charges



Anyone seeking help from an employment law solicitor service before taking a case to tribunal will have to pay an upfront fee, chancellor George Osborne has confirmed.

Addressing the Conservative Party conference in Manchester, he said a charge will be applied to all claims going to an employment tribunal, which the litigant would only get back if they won.

He argued that the government must do all it can to "respect the right of those who have spent their whole lives building a small business not to see that achievement destroyed by a vexatious appeal to an employment tribunal".

The announcement comes as the government confirms that a person needs to spend two years in a role before they can seek unfair dismissal compensation claim advice.

"We're ending the one-way bet against small business," Mr Osborne added.

The charging policy could take effect from April 2013. It is part of the government wide-ranging review of employment law, which it hopes to simplify to allow businesses to grow and take on staff more easily.

A recent British Chambers of Commerce survey reveals employment law is a major barrier to firms taking on more staff.
