Employers' Liability Compulsory Insurance 'not an optional extra'

Employers' Liability Compulsory Insurance is a legal requirement and "not an optional extra", the Health and Safety Executive (HSE) has reminded businesses during a case that could highlight an issue affecting people seeking help from a personal injury lawyer in Southampton.

Two pub managers, Stephen and Karen Martin were prosecuted after they employed staff at the Hinds Head pub in Chorley without taking out the necessary cover.

As a result, they had no means of paying employees any compensation that could be awarded if they fell ill or had an accident at work.

HSE inspectors warned the couple on several occasions between September 2010 and February 2011, South Ribble Magistrates' Court heard.

Speaking after the hearing, HSE investigating inspector Shellie Bee said: "Because Stephen and Karen Martin cut corners to save money, they were putting their employees in a position where they could have potentially suffered a life changing illness or injury at work and had no recourse to any kind of compensation."

The couple, who failed to attend the hearing and who no longer manage the pub, were each fined £1,200 and ordered to pay costs after being found guilty of failing to properly protect their staff.
