AWR could lead to more age discrimination in schools



The new Agency Workers Regulations (AWR), which come into force on October 1st, could lead to more people needing an employment discrimination claim solicitor, it has been suggested.

Speaking to Recruiter, director of Randstad Education John Dunn said schools may be tempted to lean on recruitment agencies to supply only newly-qualified supply teachers who require less pay.

This would lead to experienced teachers facing age discrimination and may result in an Employment Tribunal test case, he added.

Daniel Boucher, managing director of NP Education, added that in some cases schools would have to pay supply teachers 50 per cent more to match the comparator figure for permanent staff.

"The education sector has been more harshly treated than others because the gap between the standard supply teachers’ pay and their pay after AWR is pretty extreme," he told the publication.

AWR is designed to give agency workers the entitlement to the same basic employment and working conditions enjoyed by those who have been recruited directly.
