Family lawyers warn of concealed assets in divorce cases

Couples involved in so-called big money divorce cases are likely to conceal assets during proceedings, a survey of solicitors specialising in family law, mediation and relationships has revealed. Almost half (48 per cent) of family lawyers think husbands and wives will hide the true value of their wealth from their spouse, according to the research from accountants Grant Thornton. It follows a Court of Appeal ruling last year that forbids the use of confidential documents in divorce proceedings. The judgment stopped Lisa Tchenguiz from putting evidence before the court that was obtained without the permission of her then husband Vivian Imerman, the former owner of Del Monte foods. Lawyers warned at the time that this ruling, which overturned the Hildebrand Rules on the use of documents in family cases, would change the nature of high-value divorce proceedings.
Will Davies, partner in forensic and investigation services at Grant Thornton, said: "Rulings such as the one in Imerman could exacerbate the impact of financial difficulties and have the effect of making it increasingly difficult to ensure a fair settlement, and this will not just apply to the high-profile and big money cases."
