Unregulated will writers 'ripping off thousands'

Thousands of people are being "ripped off" by unregulated companies providing wills and inheritance tax planning services, a new report claims.

The Legal Ombudsman said the will writing industry is particularly open to abuse from unregulated operators.

It follows the decision by the Legal Services Board to instigate a review of the industry after a mystery shopping exercise revealed problems with the standard of wills.

The Legal Services Consumer Panel found that one in five wills did not come up to scratch.

Chief Ombudsman Adam Sampson said: "One service which crops up a lot is will writing. It's a service carried out often by will-writing firms who aren't regulated.

"Because of this, customers are left with little means of redress when things go wrong."

Des Hudson, chief executive of the Law Society for England and Wales, said the lack of enforcement hurts consumers because unregulated providers are not insured, do not provide a compensation fund and are not covered by the Legal Ombudsman's scheme for consumer redress.
