Banks 'present major Lasting Power of Attorney obstacle'

Banks are proving to be a major obstacle to people trying to establish Lasting Power of Attorney arrangements. Caroline Bielanska, chief executive of Solicitors for the Elderly (SFE), told the Daily Telegraph that staff are simply ill-trained to cope with requests. "They don't understand the documents that have to be seen, and the chances of it going wrong are quite high," she said. Ms Bielanska went on to stress that there remains problems with institutions accepting identification, claiming that "banks are not as smooth and efficient as people think they are". The Building Societies Association has acknowledged that there is a problem and its members have set up a working group to assess the situation. Concerns were raised last year by the SFE and the Office of the Public Guardian about the capability of banks and building societies to handle power of attorney requests. The Financial Ombudsman Service received complaints that suggested bank staff were "sometimes confused or uncertain about the different rules for old and newer types of powers of attorney", the Financial Times reported.
