Law Society questions employment tribunal proposals



Government proposals to change the point at which an employee can turn to unfair dismissal compensation claim advice have been questioned by the Law Society.

As part of wider plans to shake up employment law, the Department for Business, Innovation and Skills wants to increase the qualification period for unfair dismissal from one year to two.

The Law Society said it would support improvements to promote the "fair and effective resolution of workplace disputes and the effective running of the tribunal system".

However, in its response to the proposals, it questioned whether the government's plans are "based on sound empirical evidence and a clear understanding of the law and the tribunal system as it currently operates".

The organisation also raised doubt over the government's claim that employment tribunals are on the increase. It said this assertion is not supported by the data.

Further areas for its review of employment law were announced by the government earlier this month.

These include collective redundancy consultation periods, TUPE Regulation (Transfer of Undertakings Protection of Employment Regulations) and compensation for discrimination awarded by employment tribunals.

A response to these proposals will be submitted in due course, the Law Society said.
