Judge calls for review of 'damaging' divorce laws



A senior judge is calling for reforms to family law, mediation and relationships which he claims are "damaging".

Sir Paul Coleridge described current divorce laws as outdated and "not fit for purpose" and called on the coalition to launch a review of the legislation.

In a speech to Christian charity Care, the High Court judge said family relationships are "unrecognisable" from the 1950s, the time of the last review.

He said it was "incredible and concerning" that no review of family law, mediation and relationships had been carried out since a Royal Commission in 1950 and subsequent legislation in 1971.

"When the last major reform was introduced there was no such thing as cohabitation outside marriage," he noted.

There has been a 35 per cent increase in private law cases involving divorce and the break-up of unmarried couples in the last five years, the judge explained.

He also remarked that current rules on unmarried couples are "very harsh and unfair on unmarried woman especially mothers".

The judge also attacked pre-nuptial agreements and the decision by the Supreme Court to give these a higher legal status.

He said: "Will these new animals become commonplace up and down the land? I hope not."
