Marks & Spencer 'failed to prevent asbestos risk'

High street retailer Marks & Spencer (M&S) could be facing an asbestos compensation claim after being accused of failing to protect workers and shoppers from exposure to the material. At Winchester Crown Court, the Health and Safety Executive (HSE) accused the company of asbestos breaches at shops in Reading, Bournemouth and Plymouth. It relates to refurbishment work carried out between 2004 and 2006. M&S denies all the charges. Two of its contractors have also been charged with asbestos breaches. The company did not carry out proper planning to ensure the safety of workers and shoppers, the court heard. M&S was reluctant to free up enough floor space for the work to be carried out safely, the court was told. According to the prosecution, "Marks & Spencer had a duty to make sure asbestos did not take those working in the store by surprise." The HSE has been at the forefront of efforts to tackle asbestos breaches, registering several notable successes with its Hidden Killer campaign. According to the agency, around 20 tradesmen a week die in the UK from asbestos-related diseases. The trial continues and could last up to 15 weeks. Posted by Georgina Price
