China clay firm fined after worker fell into machinery

A China clay firm in Cornwall could be facing a head and spinal injury claim after a worker was seriously injured when he fell into machinery used to flatten bags. Imerys Minerals Ltd was fined £30,000 after it pleaded guilty to failing to ensure the safety of workers engaged in manually loading bags onto conveyors at the European Milling Centre site at Par Docks. Gerald Dahlstrom, who was 45 at the time of the incident in 2008, suffered multiple injuries to his head, shoulder and chest. He was off work for a year and continues to be affected by his injuries. In addition to fine and a possible workplace accident compensation claim, Imerys Minerals was ordered to pay over £45,000 in costs after pleading guilty at Truro Crown Court.
After the hearing, Jo Fitzgerald from the Health and Safety Executive (HSE) said: "The serious injuries suffered by Gerry Dalhstrom could easily have been avoided by Imerys if they had carried out an assessment and looked at the risks being taken by employees at the site."
It comes after the HSE reported that 123 people were killed in workplace accidents between April 1st and September 30th 2010.
