Law Society calls for will writing regulation

Anyone offering wills and tax planning services should be regulated, the Law Society has claimed as it launches a new campaign calling for professional regulation of the will writing market.
It is warning that regulation needs to come fast to end the exploitation of customers as the current situation allows for anyone in England and Wales to draft a will.
The Law Society is now lobbying the Lord Chancellor Ken Clarke and will press for an Early Day Motion in parliament demanding regulation of wills and tax planning services.
Linda Lee, president of the Law Society, explained that customers need to make sure they engage a probate solicitor service.
"It is extremely important to talk to a solicitor who can make sure that the will is expressed in a way that is legally watertight," she explained.
"A solicitor will also be able to advise on complex financial issues such as inheritance tax and trusts planning."
Unlike many will writers, solicitors are trained, regulated and must have adequate insurance to protect consumers, Ms Lee added.
The campaign comes shortly after the Society of Trust and Estate Practitioners called for urgent action to regulate will writers after identifying widespread "incompetence and dishonesty" in the will writing market.
