Judge warns of family court system slowdown

Family courts could become clogged up by people taking legal action themselves and without the aid of a solicitor, it is claimed.
Commenting on various aspects of family law, mediation and relationships, president of the High Court's Family Division Sir Nicholas Hall argued that the recession has already seen a surge in so-called DIY litigants.
Cuts to legal aid will only further slow the family court system, he told the Times, echoing comments made by the Bar Council.
Chairman of the Family Law Bar Association Stephen Cobb, QC, warned that "crude and brutal" cuts to legal aid could spell "gridlock" for the family justice system.
Speaking to the Times, Sir Nicholas said the cuts "will mean a very substantial increase in litigants in person and a subsequent slowing down of the system".
"Most people manage to resolve their disputes and many can be persuaded and assisted to do so by mediation," he added.
However, Sir Nicholas explained that there will always be those who cannot be encouraged to use mediation services to settle their differences.
