Litigation and dispute resolution proposals 'misleading'

Plans to reform the funding for litigation and dispute resolution have been criticised as "misleading", and "inconsistent" with "the fundamental principle of civil justice".
Lord Justice Jackson's report into civil litigation and dispute resolution costs has been slammed by a panel of leading academics.
Led by Bristol University professor of tort law Ken Oliphant, the group called instead for a full commission of inquiry into the issue.
Their report said: "The Jackson proposals are inconsistent with a fundamental principle of civil justice – the principle of full compensation for wrongful injury – because they entail the raiding of damages recovered by successful claimants to pay for their legal costs."
Lord Justice Jackson's measures were also criticised for treating anecdotal evidence and opinion as fact.
The impact of the proposals on access to justice would be significant, the panel of legal experts added.
Meanwhile, the Bar Council has suggested there may be serious problems for some litigants seeking access to justice as a result of the proposals.
