Supreme Court independence 'at risk'

People using litigation and dispute resolution services could find the highest court in the country is less independent. The Supreme Court's independence is under threat from the way it is funded, the court's president Lord Philips has claimed. Speaking at an event to mark a research project into judicial independence at University College London, he claimed that there is "a tendency on the part of the Ministry of Justice to try to gain the Supreme Court as an outlying part of its empire". "My conclusion is that our present funding arrangements do not satisfactorily guarantee our institutional independence," the judge added. He further warned that there are some within the ministry "who do not appreciate" that senior court staff owe their allegiance to him and not to ministers. Justice secretary Ken Clarke was quick to refute the allegations, saying that the court is subject to the same budget negotiations as other bodies.
