Divorce case splits marriage assets equally

Divorcing couples looking for advice on family law, mediation and relationships will find courts more likely to split assets accumulated over the course of the marriage evenly. The Court of Appeal, ruling on the divorce settlement between an oil tycoon and his ex-wife, said the £16 million the couple earned over their ten-year marriage should be shared evenly. It means that the assets brought to the marriage by each partner is retained by them, and does not form part of the settlement. The Court of Appeal overturned a High Court decision to award Victoria Jones £5 million, instead ruling that she should get exactly half of the £16 million that she and her ex-husband Gareth Jones accrued during their marriage. One of the three sitting judges, the High Court Family Division president Sir Nicholas Wall, said it was "unfortunate" that the law is made by big money cases like this, "which bear no resemblance to the ordinary lives of most divorcing couples". He recently told the Times that unmarried couples should be afforded property rights if they choose to break up. Posted by Gaby Hamerton
