Trust dispute cases rise as govt seeks reform

Litigation and dispute resolution services are increasingly being needed for trusts, as the number of disputed cases rises sharply. According to figures from the Ministry of Justice (MoJ), the number of legal disputes over trusts increased from 13 in 2008 to 44 in 2009. The news comes as the government publishes the results of a consultation on trust reforms. Proposals were put forward by the Law Commission to reform aspects of the law on the classification and apportionment of income and capital in trusts. "The proposed reforms aim to simplify and modernise trust law rules that create needless expense, litigation and difficulty for trustees of private and charitable trusts," the MoJ said in a statement. It noted that while the overall response has been "strongly supportive" of the reforms, there were some concerns raised by "a minority of consultees". The MoJ said the bill will be introduced to parliament when time allows, adding that it will incorporate amendments "as appropriate". Posted by Gaby Hamerton
