New guidance issued to limit workplace hearing loss

New guidance has been issued that could cut the number of industrial deafness compensation claims.

The Health and Safety Executive (HSE) has released advice that urges workers to protect their hearing or lose it.

It tells workers that if intrusive noise is a normal part of working day or if it is necessary for someone to raise their voice to be heard, then hearing loss could be a concern.

Anyone employed in contruction of handling noisy tools could also be in danger of losing their hearing.

Workers are also at risk if they "have muffled hearing at the end of the day, even if it is better by the next morning", the HSE states.

It points out that there is no need to suffer hearing loss as employers have a duty of care for the workers.

Employers must do all they can to limit the amount of noise workers have to endure if it becomes a problem, and may even have to send employees to get regular hearing checks.

Peter Hilditch, a partner at Lamport Bassitt, commented: "Any guidance providing an increased awareness of the dangers of excessive noise is always welcomed. Employees do have a duty to take care of their own safety in the workplace, but this is only likely to be effective when applied with the duties of the employer.

"An employers duty of care to provide a safe place and system of work is wide and includes reducing noise where possible, monitoring noise levels, providing hearing protection, informing employees of the dangers of noise and ensuring there is appropriate training and advice. As indicated by the HSE, regular hearing checks may also be required."

He added: "The guidance from the HSE should therefore be seen to complement, but certainly not reduce, the importance of the employer's duty to its employees."
