Sportsman wins right to anonymity



A sportsman has won the right to keep his identity secret in a litigation and dispute resolution case relating to his private life.

The man, known as JIH, won an appeal that overturned a previous High Court judgment that would have led to his identification.

Detailing the facts that can be published, Lord Neuberger explained that JIH had been in a long-term relationship with another person known as XX.

A story published during the course of this relationship and before August 2010 suggested the man had a sexual encounter with another person, whom the judge called YY.

JIH is seeking to prevent a story concerning an alleged sexual relationship with another person, referred to as ZZ.

Lord Neuberger said in the appeal court ruling: "If the media could publish the name of the claimant and the substance of the information which he is seeking to exclude from the public domain, then the whole purpose of the injunction would be undermined, and the claimant's private life may be unlawfully exposed."

The judgment comes after High Court judge Mr Justice Tugendhat ruled that his identity could be made public.ADNFCR-1678-ID-800378934-ADNFCR
