Charity wins overpaid benefits case against govt

A charity acting on behalf of thousands of private clients has won a litigation and dispute resolution case against the government. The Supreme Court has upheld a ruling that means 65,000 benefits claimants will not have to repay money given to them in error, following a case initially brought the Child Poverty Action Group (CPAG). Judges at the Court of Appeal had ruled that the government had no right to recoup millions of pounds in overpaid benefits. However, the Department of Work and Pensions (DWP) took the case to the Supreme Court, where it was dismissed. The DWP had sent out letters to the claimants threatening legal action if they failed to repay the money, prompting the test case launched by the CPAG. Chief executive of the CPAG Alison Garnham said: "We hope that the department will regret the anguish caused to many of the people who received the letters and will seek to improve its own administration to avoid overpayment problems." This week, the DWP launched a consultation process on reforming the Disability Living Allowance as part of what it is describing as a "radical overhaul of the welfare state". Posted by Gaby Hamerton
