EPC inaccuracies 'could lead to professional negligence claims'

Inaccuracies in an energy performance certificate (EPC) could result in a claim for professional negligence.
This is according to David Fleming, who made his comments in the Daily Telegraph in response to comments sent in by one reader, who noted that while his newly-converted Victorian maisonette had been predicted to generate heating and hot water costs of £421 per year, it in fact cost him £1,350 for six months.
Mr Fleming suggested that it may be possible to bring a claim for negligence against the firm that provided the EPC.
However, he cautioned that many contracts involving such businesses have some form of exclusion or restriction of liability to the seller who commissioned the report.
He went on to predict that EPCs may have to be around for longer before cases start reaching the courts.
Such certificates have been a requirement whenever a property is built, sold or rented out since October 2008.
