Mediation 'can be more effective than litigation'

Mediation, rather than legal battles, between unions and firms better serves the public good, it has been suggested. It was revealed last week (May 21st) that the Unite union successfully appealed against an injunction blocking crew at British Airways from striking, meaning three five-day walkouts are to take place, starting today (Monday May 24th). And during the process, Lord Judge, the Lord Chief Justice, stated the airline was wrong to turn to the courts in attempting to stop its staff taking action. "Legal processes do not constitute mediation," he said. Writing for the Guardian, Afua Hirsch added the result "firmly rejects the notion that going to court to enforce technical aspects of the law is a reliable way to stave off strike action". It is expected the walkouts will have a big effect on the airline's finances, after more than £40 million was lost following the seven days of strikes in March.
