Pre-nups not set to become binding, expert says

British courts are unlikely to determine that pre-nuptial agreements should be legally binding.
That is the suggestion of Nancy Duffield, senior lecturer at the College of Law, who argued that such a decision is liable to be left to parliament.
She was commenting on the case of Katrin Radmacher and Nicolas Granatino, which is being heard by the Supreme Court.
While the Court of Appeal ruled that a pre-nup signed by the pair should be recognised and many expect the higher institution to do the same, Ms Duffield said that the agreement was a particularly important factor in this instance.
But the same will not be said in other cases and the expert added: "Certainly the courts have been giving the impression that they won't say that pre-nuptials generally are going to be binding."
According to Mr Duffield, the documents will probably remain the "preserve of the rich" until legislation governing them comes into effect.
