Divorce case 'highlights complexity of document use'

A divorce battle currently ongoing between Elizabeth Tchenguiz Imerman and former Whyte & Mackay owner Vivian Imerman is going to appeal over the methods used by the wife to obtain documents.
As part of her case, Ms Tchenguiz's is using details of her spouse's tax affairs, bank statements, e-mails to financial advisers and credit card statements, which were downloaded by one of her brothers who shared an office with him for several years, the Financial Times reports.
Mr Imerman has been granted permission to take his grievance concerning the use of the information to the Court of Appeal - which hears all appeals in leading cases of civil and family justice.
In light of the ongoing case, legal expert Andrew Greensmith has called for clearer guidance on the issue of what information can be used in divorce cases.
He said: "There is a duty on the part of both parties to provide documents and if one party thinks the other is not doing that, they sometimes resort to obtaining the information themselves."
Mr Greensmith went on to suggest that this can lead to considerable "satellite litigation".
