Lord Jackson's civil litigation plans 'divide opinion'



Plans announced recently by Lord Justice Jackson as part of an attempt to improve access to justice have split opinion, it has been suggested.

In a potential shake-up of civil litigation costs, he drew up ideas under which systematic change would be implemented to produce a tightly regulated market.

One of the measures Lord Jackson put forward was a cap on the scale of success fees.

He stated that 'no win, no fee' lawyers acting for a successful claimant should not be able to charge such fees to losing defendants.

Rather, claimants winning lawsuits would have to pay a success fee out of their own compensation and payouts would be increased to take this into account.

According to the Times, the measures have been a "talking point" across the legal profession.

It stated: "Opinions remain divided with lawyers working with middle-sized businesses, in particular, expressing their reservations about how their clients would be affected."
