Building firm ordered to pay compensation for HSE breach



A building firm has been ordered to pay costs, fines and compensation totalling thousands of pounds for not complying with the terms of the Health and Safety at Work Act.

Richard Dewey, director of F Dewey, pleaded guilty to the failure after plumber Peter Flippance suffered a broken wrist and hip after falling through the roof of a building site on River Street, Pewsey, This Is Wiltshire reported.

Existing buildings on the site were being demolished in order to make space for a new residential development and Mr Flippance, who had no training in demolition, fell through a roof made of asbestos sheeting onto a concrete floor.

According to Elizabeth Trzoska, prosecuting on behalf of the Health and Safety Executive (HSE), no proper risk assessment had been undertaken and no arrangements were made to prevent the spread of asbestos dust at the site.

Mr Flippance was off work for 11 months and is likely to require further surgery on his wrist following the incident, magistrates in Devizes were told.

F Dewey was ordered to pay £5,000 in compensation to Mr Flippance, £7,000 in prosecution costs and £15,000 in fines - which was reduced to £10,000 in recognition of Mr Dewey's early guilty plea.

Last week, the HSE issued a reminder to construction firms of the importance of carrying out a full risk assessment of a project after a crane company was fined over the deaths of two workmen.ADNFCR-1678-ID-19318998-ADNFCR
