Parents 'updating wills before summer holidays'

Amid fears of swine flu, the high-profile custody battle over Michael Jackson's three children and the recent Air France disaster, parents are choosing to ensure their wills are updated before setting off on a summer family holiday.
This Is Money reported that lawyers are noting increased awareness among clients of the importance of making a will - particularly among those who have children under the age of 18.
Under English law, people with 'parental responsibility' - both the mother and father if the child was born while they were married, or just the mother if the child was born out of wedlock - are permitted to appoint a legal guardian to any minor children should they die before the child turns 18.
According to the newspaper, parents are advised to discuss who to appoint as a guardian together and make sure this individual is happy to accept the role.
Furthermore, a letter of wishes should be used by the parent to outline to the guardian how the children should be cared for in the event of their death - including specifics such as religion and education. While these statements are not legally-binding, it may provide greater clarification and ensure the wellbeing of the children.
Age should not be a factor when considering when to make a will, as adults of all ages should have this important legal document in place.

It can also be used as a vehicle for preserving family heirlooms by directing them to members of the family who might best be suited to look after them and pass them on. Provisions can be made for your beloved pet and its future care.
